Typical contract

What is a typical contract?

Contracts can be classified into typical and atypical depending on whether or not they are regulated by law.

A typical contract is one that has a specific legal regulation, that is, the law defines its name, its nature, its requirements and its effects. This type of contract must comply with what the law establishes, although the parties may agree to something different as long as it does not go against imperative laws.

For example, the trade contract, the lease contract or the loan contract are typical contracts that are regulated by the Civil Code or the Commercial Code.
