Abuse of rights

What is the abuse of rights?

Abuse of rights is a legal concept that refers to the use of a right or faculty in an excessive, disproportionate manner or contrary to its legitimate purpose, with the aim of harming others or obtaining undue advantages.

This concept holds that people should not misuse the rights granted to them by law to harm others or for unlawful purposes. In many legal systems, the aim is to prevent someone from taking advantage of your rights in a way that is detrimental to others or to public order.

An example of abuse of rights could be if someone uses your property to deliberately block access to your neighbor’s property, without a legitimate reason. In this case, even though the person has the right to use your property, his excessive and malicious use of the right could be considered an abuse.
